1. AGREEMENT

The websites found at www.AnytimeDentalImplantCenter.com and all its related pages (together called the “Site”) are protected by copyright and belong to Anytime Dental Implant Centers LLC (“Anytime Dental Implant Centers”, “we”, and “our”). Anytime Dental Implant Centers provides services, helps you book appointments, and carries out other tasks you ask for (all together called the “Services”) on the Site. Some parts of the Services or Site may have extra rules or guidelines, which will be shared on the Site or along with those specific features. These extra rules are a part of these Terms.

These Terms of Use (the “Terms”) explain the rules you must follow when using the Site and Services. By visiting or using the Site or Services, you agree to these Terms (for yourself or for the group you represent) and you confirm that you have the right and ability to accept these Terms (for yourself or for the group you represent). IF YOU DO NOT AGREE WITH ALL THE PARTS OF THESE TERMS, PLEASE DO NOT USE THE SITE OR SERVICES. These Terms also include Anytime Dental Implant Center’s Privacy Policy, which you can find at www.AnytimeDentalImplantCenter.com/legal/privacy-policy/ (the “Privacy Policy”).

2. MODIFICATION OF THESE TERMS OF USE

Anytime Dental Implant Centers has the right to change any part of these Terms and any extra rules related to the Services at any time, without giving you notice beforehand. You agree that we can inform you about any updated Terms and any extra rules by changing the “Last Updated” date above. All changes are effective right away when we post them, or on a later date if stated in the update notice. If you do not agree with any changes, your only option is to stop using the Service.

3. CONDITIONS OF YOUR USE

  • You cannot use the Services unless you are at least eighteen years old.

The information on this Site is general and not specific to any individual patient’s needs. The information can help you make informed decisions about healthcare topics. Using this Site does not create a doctor-patient or provider-patient relationship. This information is not meant to take the place of advice from a healthcare professional, and you should always talk to a Anytime Dental Implant Centers professional for diagnosis and treatment of any dental health issues. Do not ignore any advice or treatment from your dentist or healthcare provider based on what you read on the Site.

Anytime Dental Implant Centers has the right to take over the defense of any issue for which you need to protect us, and you agree to help us with our defense of these claims. You also agree not to settle any issue without getting written permission from Anytime Dental Implant Centers first. Anytime Dental Implant Centers will try to inform you about any claim or action as soon as we find out about it.

11. LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES WILL WE (OR OUR AFFILIATES) BE RESPONSIBLE TO YOU OR ANY OTHER PERSON FOR ANY LOST PROFITS OR ANY INDIRECT, SPECIAL, OR PUNITIVE DAMAGES THAT COME FROM OR RELATE TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF WE HAVE BEEN TOLD ABOUT THE POSSIBILITY OF SUCH DAMAGES. ACCESSING AND USING THE SITE AND SERVICES IS AT YOUR OWN RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER OR LOSS OF DATA THAT MIGHT HAPPEN AS A RESULT.

NO MATTER WHAT, OUR RESPONSIBILITY TO YOU FOR ANY DAMAGES RELATED TO THESE TERMS (FOR ANY REASON AND REGARDLESS OF THE TYPE OF ACTION) WILL ALWAYS BE LIMITED TO THE GREATER OF (A) FIFTY US DOLLARS ($50); OR (B) THE AMOUNTS YOU HAVE PAID TO ANYTIME DENTAL IMPLANT CENTERS IN THE LAST 12 MONTHS (IF ANY). HAVING MORE THAN ONE CLAIM WILL NOT INCREASE THIS LIMIT.

SOME PLACES DO NOT ALLOW LIMITS ON LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

12. TERM AND TERMINATION

These Terms will stay in effect as long as you are using the Site or Services. We may (a) temporarily suspend your ability to use the Site or (b) end these Terms at any time for any reason we choose, including if you break any of these Terms while using the Site or Services. You understand that if we end our Services, any Content you have provided will be deleted.

13. GOVERNING LAW AND DISPUTE RESOLUTION

  • Governing Law and Venue

These Terms will follow the laws of the State of Ohio, without considering any conflicting laws from other places. If there is any action or issue related to these Terms or the Site or Services (called a "claim"), it must be taken to a state court in Stark County, Ohio, or a federal court in Akron, Ohio. Both sides agree to follow the rules of these courts. However, if the claim goes to arbitration (a different way to settle disputes), then that will be handled separately. Anytime Dental Implant Centers can also seek help from any court to protect its intellectual property or confidential information.

  • Contact Anytime Dental Implant Centers First

If you have a problem with Anytime Dental Implant Centers, we want to hear about it and try to fix it. If we cannot solve it to your satisfaction, we will help you find a fair and low-cost way to resolve the issue quickly. You agree to tell us about any problem you have with Anytime Dental Implant Centers by emailing webmaster@AnytimeDentalImplantCenter.com.

  • Alternative Dispute Resolution

For any claim where the amount you want is less than $10,000 USD, you can choose to resolve the issue through a special type of arbitration that does not require you to appear in person. This will be done by a recognized arbitration provider that both sides agree on. The arbitration can happen in one of the following ways: by phone, online, or through written submissions. There will be no personal appearances unless both sides agree. Any decision made by the arbitrator can be enforced in any court that has the authority.

  • Improperly Filed Claims

        All claims between you and Anytime Dental Implant Centers must follow this Section 13. Claims that do not follow this Section will be considered improperly filed. If you file a claim that does not follow these rules, Anytime Dental Implant Centers can recover attorney fees and costs up to $1,000, as long as we have told you in writing about the improperly filed claim and you do not withdraw it quickly. Similarly, if Anytime Dental Implant Centers files a claim that does not follow these rules, you can recover attorney fees and costs up to $1,000, as long as you have informed Anytime Dental Implant Centers in writing about the improperly filed claim and we do not withdraw it quickly. These remedies do not limit any other options that either side may have in the law.

        User Submissions: Anytime Dental Implant Centers Management Services, LLC (referred to as "ADICMS") welcomes your comments and submissions. When you submit your own content, including images, text, and videos (called “User-Generated Content” or “UGC”) to CCMS’s website, mobile apps, or social media pages (together called the “Services”), you agree to follow these Terms of Use. If you do not agree with all the terms, please do not send us your UGC. By agreeing to these Terms of Use and submitting your UGC, you promise that:

          • You are at least eighteen years old and are considered an adult in the state or country where you live.
          • You own all the rights to the UGC, including any photos or videos that are part of it.
          • You have the full power to agree to these Terms of Use.
          • The UGC is your own original work (not copied from another website or social media) and does not violate anyone else's rights.
          • The UGC does not include personal information about yourself or anyone else, like names, addresses, or health information. By posting the UGC, you understand that any information about your treatment is no longer protected health information.
          • The UGC does not include trademarks, logos, brand names, or advertising that belongs to anyone else besides you or CCMS.
          • The UGC does not contain anything illegal, harmful, false, or offensive.
          • The UGC does not promote any products, services, or commercial activities, except for those offered by CCMS.
          • The UGC does not have harmful material like viruses or other harmful programming that could damage CCMS’s systems or data.
          • You have permission from anyone appearing in the UGC to give us the rights to use it as described in these Terms of Use.
          • Your upload of the UGC does not break any laws or the rules of the social media platforms where you posted it.
          • The use of your UGC by CCMS and others as described in these Terms of Use will not violate anyone else's rights and will not break any laws.
          • You confirm that CCMS's use of your UGC does not require any payment to anyone or any extra permissions from others.
          • You have read and agree to follow all the terms in these Terms of Use.
          • By submitting your User-Generated Content (UGC), you give CCMS and its related companies, partners, agents, and other service providers (called the “Licensed Parties”) the right to use your UGC around the world. This right is permanent, cannot be taken back, and does not require you to be paid. The Licensed Parties can publish, share, change, distribute, print, post, and create new works from your UGC for their business and advertising purposes. This can include using your UGC on their websites, in promotional emails, advertisements, and other marketing efforts. They can do this in any media now or in the future, with or without your username, real name, image, voice, location, or any other identifying information.
          • If applicable, you also allow the Licensed Parties to use your username, real name, image, voice, and other identifying information in connection with your UGC as described in these Terms of Use.
          • You agree to give us all the permissions needed by law to use your UGC and the rights you are granting us in these Terms of Use. If we ask, you will sign any documents needed to protect or enforce the rights you have given us. Additionally, you give up any moral rights or similar rights you may have under current or future laws anywhere in the world. You will not have the right to approve or review how your UGC is used, and you will not receive any payment for its use.
        • Whether we decide to use your User-Generated Content (UGC) is entirely up to us. We are not required to use your UGC and can remove or stop using it at any time for any reason. Using your UGC does not mean that we support or are connected to you in any way.

        You also allow other users of the Services to access, view, save, share, or reproduce your UGC for their personal, non-commercial use. The Licensed Parties do not have to keep your UGC private, and they can edit, copy, change, show, publish, and distribute any UGC you provide without paying you or anyone else for it. By allowing your UGC to be shown on the Services, you understand that the Licensed Parties are not publishers of that UGC; they simply help you share and display it. The Licensed Parties do not guarantee the accuracy, completeness, or reliability of any UGC displayed, uploaded, or shared by you or any other user.

        If you have a special connection to CCMS (like being an employee, agency worker, sponsored blogger, or paid influencer), you need to let people know this when you post.

        By using the Services, you agree that you will not post or share any of the following:

          • Anything that disrupts or interferes with the Services.
          • Anything that is rude, offensive, false, or misleading, or that breaks the law in any way.
          • Unauthorized copyrighted materials or anything that violates someone else's rights.
          • Anything that encourages illegal activities or could lead to legal issues.
          • Anything that could harm minors.
          • Anything that pretends to be someone else or misrepresents your connection to any group.
          • Files that contain harmful code, viruses, or any software that could damage someone else's computer or network.

        By allowing the Licensed Parties to use your UGC, you free them from any claims, actions, or legal issues that may come up from their use of your UGC or from any violations of these Terms of Use by you.
